These are the Terms & Conditions for renting Sunnydale Villa, Solana Resort in Florida:
The owners of the property Sunnydale Villa offer the short term rental of the property to the person of 21 years or over named as the party leader and to the named party members (on the registration form), hereinafter referred to as the Guest, under the terms set out below.
Email Booking
The owner will provide a written quotation valid for 15 days showing total rental fee. Quotations are valid for 15 days, unless and until the Property is either booked by a third party, or the owner receives a deposit from any party. Until the Owner receives deposit, the Owner reserves the right to accept any booking for the Property.
Confirmed Booking
On receipt of the required payment from the Guest, the Owner will issue a rental agreement by email to the Guest. Only on release of the Rental Agreement from the Owner is the booking determined as confirmed.
Acceptance
The Guest agrees that payment of the rental deposit will signify their full acceptance of these Terms and Conditions. The rental deposit to confirm your booking will be $250.00 with the remainder of balance due 30 days prior to your arrival date. Should your booking be less than 30 days prior to your arrival date the full amount nust be paid in full to accept your booking confirmation.
Payments
The Guest agrees that the owner will not release the Property before full payment is received within the terms of the Rental Agreement. In the event of late payment or failure to pay, the Owner reserves the right to cancel said Booking and levy cancellation penalties.
Rental Period
The Guest agrees, and the owner permits the Rental Period to begin and end on the dates shown on the registration form.
Check In/Out
Unless otherwise agreed in writing check in time is after 4:00 pm on the date of arrival and check out time is 11:00 am on departure date.
Security Deposit
Acceptance to rent the property confirms that the Guest is responsible to pay for any damages of any kind caused by the occupancy of the Property. The cost of repairs and/or replacements will be deducted form the security deposit. The Security deposit will be returned to the Guest within 30 days after departure, providing there are no claims against it. In the event of any damages to the Property or inventory or cleaning costs in excess of the Security Deposit the owner reserves the right to seek legal remediation and such costs are payable within 14 days. The Security deposit will be $300.00 held in above your rental fee. Once the villa has been cleared by the management company your $300.00 security deposit will be returned to you.
Cancellation
In the event that the Guest exercises their right to cancel, the Owner will levy the following cancellation penalty percentage rates of the Total Rental Fee minus the $250.00 deposit. The deposit to secure your dates is NON REFUNDABLE as once these dates are confirmed for you we turn customers away for those booked dates. Up to 60 days prior to arrival 20%, 30 - 60 days of arrival 50%, 15 -30 days of arrival 75%, less than 15 days prior to arrival date 100%. We recommend guests purchase their own travel insurance to compensate in the event of cancellation.
Pets/Smoking
The guests confirm that the Property is a non-smoking home and that Pets are not allowed on the property for the comfort of all guests. Any damages or cleaning required, as a result of smoking or pets will be payable by the Guest at a rate of $100.00 per room.
Parking
The Property has parking to accommodate 2 regular passenger vehicles. No other vehicle parking is allowed such as trailers, RVs. The Owner is not responsible for violations to municipal parking infractions.
Disclaimer
This Villa is privately owned and neither the Owner nor Property Manager accept any liability whatsoever for personal injury, accidents, loss or damage to persons or personal effects however caused. The Guests acknowledges that a swimming pool is present on the property and the Owner assumes no responsibility for its use or protection of its guests.
Service Level
The Owner makes all reasonable efforts to maintain the Property and Equipment in good order. When notified we will endeavor to repair within 24 hours. No refunds are granted for malfunctioning mechanical or electrical failure (other than cost of heat refund for Pool if requested). This includes but not limited to TVs, Satellite service, audiovisual equipment, games or movies, Internet access.
Code of Conduct
Solana Resort is a residential community. The actions of Guests should not interfere with the enjoyment of others. Please refrain from loud music between 11pm and 8am. In the event that Guest or any member of the party behaves in a manner in which authorities request the Guest to vacate the property the Owner shall not be held responsible nor will any refund of monies be given.
Force Majeure
The owners of the property will not be liable for loss or delay occasioned by any of the following: Strikes, Riots, Political Unrest, Hostilities, War, or Threat of War, Terrorist Activity, Hurricanes/Tornados, Closure of Airports or any other event beyond the Owners control. If we have to cancel your booking due to events beyond our control, we will do our best to find alternative accommodations, however, we cannot accept any liability whatsoever in respect of any loss or damage sustained the Guest under these circumstance.
